Terms of Service

1. Acceptance of Terms

By accessing, purchasing, or using any services, websites, game servers, APIs, databases, analytics tools, supporter features, or related services operated by Pickle Servers L.L.C. ("Pickle Servers," "we," "us," or "our"), you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you may not access or use our services.

2. Purchases and Refunds

2.1 Final Sales

All purchases are final and non-refundable except where required by applicable law.

2.2 Chargebacks and Payment Disputes

If a chargeback, payment dispute, or unauthorized refund is initiated, we reserve the right to:

  • suspend or terminate access to any services;
  • revoke supporter benefits;
  • restrict future purchases;
  • permanently ban associated accounts; and
  • record the associated identifiers for fraud prevention and enforcement purposes.

3. Access to Services

3.1 License to Access

Subject to these Terms, Pickle Servers grants you a limited, revocable, non-exclusive, non-transferable license to access and use our services for personal use.

No ownership rights are transferred to you.

3.2 Suspension and Termination

We may suspend, restrict, or terminate access to any service at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion.

4. Data, Analytics, and Supporter Features

4.1 Ownership

All databases, datasets, analytics, classifications, rankings, reports, historical records, compilations, visualizations, supporter features, and related content provided through our services are owned by Pickle Servers or its licensors to the extent permitted by law.

4.2 Restricted Access Content

Certain content may be available only to supporters, subscribers, donors, administrators, or other authorized users.

Content made available through restricted-access features is not considered public merely because an authorized user can view it.

4.3 Prohibited Data Use

You may not, directly or indirectly:

  • scrape, crawl, harvest, extract, copy, mirror, index, archive, or collect data from our services using automated or manual means;
  • create or maintain a competing database using information obtained from our services;
  • republish, redistribute, sell, sublicense, share, disclose, or commercially exploit data obtained through our services;
  • use our services as a source for any public database, search engine, analytics platform, intelligence platform, monitoring service, or similar product;
  • provide data obtained from our services to third parties for publication, indexing, aggregation, or commercial use;
  • circumvent access restrictions, rate limits, account limitations, or technical protections; or
  • use our services to develop, improve, train, or operate competing products or services.

4.4 Competing Services

You may not use information obtained from our services to operate, support, develop, market, maintain, or enhance any competing service, database, analytics platform, moderation platform, intelligence platform, search platform, or similar product.

4.5 User Responsibility

You are responsible for any data exported, copied, captured, shared, or disclosed through your account.

Providing data obtained from our services to a third party constitutes a violation of these Terms unless expressly authorized in writing by Pickle Servers.

5. Monitoring and Enforcement

We reserve the right to investigate suspected violations of these Terms.

We may use technical, contractual, and legal measures to prevent unauthorized access, scraping, copying, redistribution, or misuse of our services and data.

Violations may result in suspension, termination, legal action, and claims for damages or injunctive relief.

6. Database Sharing for Administration

6.1 Administrative Records

For administrative and security purposes, we may maintain records relating to player accounts, Steam IDs, transactions, bans, chargebacks, enforcement actions, and related activity.

6.2 Authorized Sharing

Such records may be shared with authorized administrators, partners, payment providers, fraud prevention services, legal representatives, or other parties as reasonably necessary to operate our services, enforce these Terms, prevent abuse, or comply with legal obligations.

7. Intellectual Property

All software, databases, website content, graphics, designs, analytics, compilations, reports, and service features are protected by applicable intellectual property and other laws.

Except as expressly permitted by these Terms, no portion of the services may be copied, reproduced, distributed, or used without prior written permission.

8. Disclaimer of Warranties

The services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Pickle Servers disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

9. Limitation of Liability

To the fullest extent permitted by law, Pickle Servers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the services.

Our total liability for any claim shall not exceed the amount paid by you to Pickle Servers during the twelve months preceding the event giving rise to the claim.

10. Injunctive Relief

You acknowledge that unauthorized scraping, copying, redistribution, disclosure, or commercial exploitation of data obtained from our services may cause irreparable harm.

Accordingly, Pickle Servers shall be entitled to seek injunctive relief, equitable relief, and other remedies in addition to any available monetary damages.

11. Governing Law and Venue

These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the services shall be brought exclusively in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.
